Welcome to Cushnshop! “We”, “us”, and “our” mean Cushnshop. Cushnshop runs this website and store – including all content, features, tools, products, and services – to give you a tailored shopping experience (the “Services”). Cushnshop is powered by Shopify, which helps us provide the Services to you.

These Terms of Service (“Terms”) together with any policies we link to explain your rights and responsibilities when using our Services.

By accepting these Terms, you confirm you are the legal age in your state or province of residence. You also allow any minor dependents to use our Services on devices you own or control.

You are fully responsible for keeping your account login details secure and for everything that happens under your account. You may not transfer, sell, or give your account to anyone else.

We try hard to show our products accurately. However, colors and appearance may vary depending on your device screen and settings.

We do not guarantee that any product you buy will match your expectations or look exactly like the images online.

Placing an order means you are offering to buy. Cushnshop may accept or reject your order for any reason. Your order is only accepted when we send you a confirmation email. We must receive and process your payment before that happens.

Please double-check your order before submitting – after acceptance, we may not be able to cancel it. If we reject or change your order, we will try to notify you using the contact info you gave us.

All purchases are subject to our Refund Policy [LINK]. You promise that you buy for personal or household use, not for resale or export.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions can change without notice. The price you pay is the one in effect when you place your order, as shown in your order confirmation email. Unless we say otherwise, prices do not include taxes, shipping, handling, customs, or import fees.

Our online prices may differ from prices in physical stores or on other websites. Promotions may have extra rules; if those conflict with these Terms, the promotion’s rules apply.

You agree to give us current, complete, and accurate purchase and payment information. You also agree to update your account (like email or credit card details) so we can finish your transactions and contact you if needed.

You confirm that (i) your credit card info is true and correct, (ii) you are authorized to use that card, (iii) your card company will honor the charges, and (iv) you will pay all charges, including shipping and taxes.

We are not liable for shipping or delivery delays. Delivery times are estimates only – we do not guarantee them. We are not responsible for delays caused by carriers, customs, or events outside our control. Once we hand products to the carrier, you take ownership and risk of loss.

Our Services – including trademarks, text, images, graphics, product reviews, videos, audio, and their arrangement – belong to Cushnshop, its affiliates, or its licensors. They are protected by US and international patent, copyright, and other intellectual property laws.

These Terms allow you to use our Services only for personal, non‑commercial purposes. You may not copy, distribute, modify, create derivative works, publicly display, republish, download, or transmit anything from our Services without our prior written permission. Nothing here gives you a license to our intellectual property (or Shopify’s or any third party’s). Unauthorized use may violate federal or state laws. All rights not expressly granted are reserved by Cushnshop.

Cushnshop’s names, logos, product names, designs, and slogans are our trademarks. Shopify’s trademarks belong to Shopify. Other trademarks belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third‑party tools as part of the Services. We do not monitor those tools and have no control over them.

You acknowledge that we offer these tools “as is” and “as available” without any warranties or endorsements. We are not liable for anything arising from your use of optional third‑party tools. You use them at your own risk, and you should review the terms of the third party that provides them.

We may introduce new features or tools in the future – they will also be governed by these Terms.

SECTION 8 – THIRD‑PARTY LINKS

Our Services may contain links to third‑party websites or content. We do not review or control those sites and are not responsible for their accuracy or anything on them. If you leave our Services to visit a third‑party site, you do so at your own risk.

We are not liable for any harm or damages from accessing third‑party websites or buying/using their products or services. Read their policies carefully before any transaction. Complaints or questions about third‑party products should go directly to that third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Cushnshop uses Shopify to power the Services. However, any sale you make in our Store is directly between you and Cushnshop. By using our Services, you agree that Shopify is not responsible for any aspect of your purchases or transactions with us, including any injury, damage, or loss from products you buy. You release Shopify and its affiliates from all claims, damages, and liabilities related to your purchases with Cushnshop.

SECTION 10 – PRIVACY POLICY

We may (but do not have to) remove Feedback that we find illegal, offensive, threatening, defamatory, obscene, or that violates these Terms or someone else’s rights.

You agree that your Feedback will not violate any third‑party rights (including copyright, trademark, privacy) and will not contain malware. Do not use fake email addresses or pretend to be someone else. You are solely responsible for your Feedback.

SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS

Occasionally our Services may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any errors and to change or cancel orders if information is wrong – even after you’ve placed your order – without prior notice.

You may only use our Services for lawful purposes. You may not, directly or indirectly:

  • Spam, phish, pharm, or pretext our Services.

  • Use robots, scrapers, AI tools, or automated methods to access our Services.

If you violate any part of these Terms, we may suspend or terminate your account without notice.

14.1 These “Agent Terms” apply if you deploy an Agent (software or service that takes autonomous action on your behalf without direct supervision) to interact with our Services.

14.2 An Agent may only access our Services if it always identifies itself and strictly follows the rules in 14.4. It may not access our Services if we have asked it to stop.

14.3 We may use technical measures to limit whether and how an Agent can use our Services.

14.4 Agents must: (i) include “Agent/[agent name]” in the user agent string of every HTTP/HTTPS request; (ii) not hide that they are automated (e.g., by mimicking human behavior or solving CAPTCHAs); (iii) answer truthfully when asked if they are human or automated; (iv) not circumvent any measures we use to control Agent access.

SECTION 15 – TERMINATION

We may end this agreement or block your access to the Services at any time, for any reason, without notice. You will remain liable for all amounts due up to the termination date.

After termination, the following sections survive: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that naturally should survive.

SECTION 16 – DISCLAIMER OF WARRANTIES

The information on our Services is for general purposes only. We do not warrant its accuracy, completeness, or usefulness. You rely on it at your own risk.

EXCEPT AS EXPRESSLY STATED BY CUSHNSHOP, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR‑FREE. SOME JURISDICTIONS DO NOT ALLOW THESE DISCLAIMERS, SO THEY MAY NOT APPLY TO YOU.

SECTION 17 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, CUSHNSHOP, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS (AND THOSE OF SHOPIFY) SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS YOU PURCHASE – EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SECTION 18 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Cushnshop, Shopify, and our affiliates, officers, directors, employees, agents, and service providers from any losses, damages, claims, or expenses (including reasonable attorneys’ fees) arising from (1) your breach of these Terms, (2) your violation of any law or third‑party rights, or (3) your use of the Services.

We will notify you of any such claim. We may control the defense and settlement (at your expense), but we will not settle any claim that requires you to take non‑monetary action without your consent (which you may not unreasonably withhold). You will cooperate with us, including by providing relevant documents.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force.

SECTION 20 – WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision does not waive that right.

These Terms and any policies we post on this site constitute the entire agreement between you and us. They supersede any prior or contemporaneous agreements, communications, or proposals (oral or written). Any ambiguity shall not be construed against the drafting party.
